Most states have passed legislation that criminalizes drunk drivers and requires them to spend time in jail, regardless of whether or not there is an accident or property damage involved, in some cases they are victims of distracted drivers or are not driving at all. Yes, that's right you don't have to be driving in some states as long as you are in a motor vehicle with keys or the ability to start the car they can arrest you for drunk driving. The states range from a .05 - .08 Blood Alcohol Content (BAC) level in order to prosecute, which enables police officers and prosecuting attorneys to wield a great deal of power. This amount of alcohol in a person's system can equate to a glass of wine with dinner at a restaurant or an after dinner cocktail.
These laws have had a negative impact on many facets of our lives, creating additional issues with the criminal justice system and unintended societal impacts. The laws and regulations must be changed to promote just and fair consequences. Penalties should fit the severity of the offense, there is not a one size fits all solution. |
