A Call for Reform
1. Remove arbitrary BAC levels from legislation to:
a. promote legislation that focuses on driving impairment
b. eliminate arrests that do not involve driving
c. eliminate costly checkpoints
2. Decriminalize drunk driving charges in cases that do not involve harm to
individuals, property or damage.
a. There are already laws in place to address traffic accidents that cause harm or
b. Using administrative procedures in the DMV alleviates the strain on the criminal
court system, incarceration facilities and social services.
i. It also removes the double jeopardy automated procedure in place
in many states which increases an administrative punishment once a criminal
conviction is passed down without a new trial.
c. Efforts need to be focused on rehabilitation instead of jail and criminalization.
3. Remove the three strike rule.
a. These laws cause a DUI, DWI, OWI, DWAI, DWI or similar charges/convictions to
stay on a person’s record for a lifetime in some states, even bankruptcy goes away
